Pre-Arrest and Post-Arrest Bail in Pakistan

The general legal procedures and considerations involved in bail applications.

Bail is a procedural question: whether a person should remain at liberty while an allegation is investigated or tried. It is not a decision about guilt. This note explains the distinction people most often need at the start of a criminal case.

Pre-arrest bail

Pre-arrest bail is sought when a person apprehends arrest. In Pakistan it is commonly discussed with reference to section 498 of the Code of Criminal Procedure, 1898, and it is moved before the competent Sessions Court or High Court, depending on the case. The court looks at the allegation, the material placed before it, and whether arrest would be unjust in the circumstances. It is discretionary.

Post-arrest bail

Post-arrest bail is sought after a person is in custody. Bailable offences are treated differently from non-bailable offences. For many non-bailable offences, section 497 of the Code of Criminal Procedure is the provision ordinarily discussed. The court considers the offence, the material, and the settled grounds on which bail is granted or refused. Those grounds are applied to the facts of the case. They are not a formula that produces the same result every time.

Interim bail and confirmation

A court may grant interim bail for a short period and then decide whether to confirm it. A date for confirmation is a date that needs to be kept. Missing it can undo the protection the interim order gave.

What to have ready

The FIR, any notice, the offence cited, and the dates of arrest or of the events alleged are the usual starting documents. If arrest has not happened but is expected, say that clearly when you call.

Bail-related inquiries can be made 24 hours a day. Representation depends on availability, assessment, and acceptance of instructions. No bail outcome is guaranteed.
